Pool Safety: Are You Compliant?

Protect what truly matters

Owning a pool is a source of enjoyment—but it also comes with significant responsibility. Every year, preventable accidents occur due to inadequate safety measures.

Quebec regulations are clear and are designed to help protect children, your loved ones, and anyone using your property.

Why a fence is mandatory

Even a shallow pool presents a real risk to young children.

The law requires a secure enclosure to:

  • Prevent unsupervised access
  • Reduce the risk of drowning
  • Hold property owners accountable

Essential Rules to Follow

Here are the basic requirements of the regulations (simplified summary):

  • Fence Required around the Pool
  • Minimum height: 1.2 metres (4 feet)
  • Must be impossible to climb (no footholds or handholds)
  • Safe spacing that prevents a child from passing through

Secure Access

  • Gate with self-closing and self-latching mechanisms
  • Latch out of reach of children
  • Self-closing gate
  • No structures that could facilitate climbing
  • No accessible ladder
  • No objects nearby that could aid access (furniture, BBQ, etc.)

Special cases to consider

Each type of pool has its own specific requirements.

Tip: Even if your pool installation is older, it must still be brought up to current standards.

Pool Type Special Requirements
Above-Ground Pool Access must be secured (removable ladder or fenced platform)
In-Ground Pool A complete fence enclosure is mandatory
Semi-Inground Pool A hybrid case — requirements must be verified based on the installation

The regulation applies to all new installations as of July 1, 2021, with certain exceptions for installations acquired before that date. It also applies to existing installations. Installations that were in place before November 1, 2010, must comply with the regulation no later than September 30, 2027.

Certain older installations may, however, remain in place as long as they are not replaced and continue to comply with the standards that were applicable to them.
